1.1. tefoLOGIC Inc. is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using website[s], software, applications, hardware, Cloud infrastructure hosted and maintained by us; then you can be assured that it will only be used in accordance with this privacy statement.

1.2. This privacy policy has been compiled to better serve those who are concerned with how their ‘Personally identifiable information’ (PII) is being used online. PII, as used in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context.

1.3. We have amended this policy to be compliant with General Data Protection Regulation (“GDPR” – Regulation (EU) 2016/679), for the benefits of our European customers and partners (resellers). Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.

2. What personal information do we collect from the people that visit or use our websites or apps or infrastructure?

2.1. When ordering or visiting or registering on our website[s], software, applications, hardware, Cloud infrastructure hosted and maintained by us, as appropriate, you may be asked to enter your name, email address, telephone number, company name, company address, position in the company or other details to help you with your experience and help us to maintain your account at tefoLOGIC Inc.

2.2. When you sign up, you need to agree to our terms of service agreement. Also, when you use website[s], software, applications, hardware, Cloud infrastructure hosted and maintained by us; on our website[s], you will see a popup window for cookies consent, which means that by continuing to surf the website[s], you consent with our privacy policy.

2.3. We post user testimonials on our website. These testimonials may include names and other Personal Information and we acquire permission from our users prior to posting these on our website. tefoLOGIC Inc. is not responsible for the Personal Information users elect to post within their testimonials.

 

3. When do we collect information?

3.1. We collect information from you when you register on our site or enter information on our website[s], software, applications, hardware, Cloud infrastructure hosted and maintained by us. Also, we collect information when you visit our website[s], software, applications, hardware, Cloud infrastructure hosted and maintained by us.

3.2. How do our algorithms work?

3.2.1. The live video stream is analysed on-the-device [real-time in-memory] and never stored.

3.2.2. There is no-way to store or send or transmit any images or videos to any device or servers.

3.2.3. The algorithm uses real-time computer vision algorithms and live-stream from the camera to:

3.2.3.1. detect human faces in the digital images provided by the camera;

3.2.3.2. track each detected person while they remain within the camera's field of view;

3.2.3.3. anonymously determine gender, age and attention time of each detected person.

3.2.4. The software uses video images to get such numeric indicators as the current number of viewers, their gender, age group and attention time. Personal Identifiable Information (PII) is collected; hence it/they remain(s) fully anonymous:

3.2.4.1. the abstract numeric indicators are formed into anonymous aggregate data;

3.2.4.2. the real-time computer vision process that doesn't store or relay any visual information guarantees its absolute privacy.

3.2.5. Our Computer Vision algorithm(s) product/service shall not be considered to be a video surveillance system since it does not record any video files.

3.3. Anonymity of the Data

3.3.1. The algorithm doesn't record any personal information of an individual.

3.3.2. There are two possible utilizations of data produced by the system:

3.3.2.1. the data is written to a text file and uploaded into a central database where it is aggregated for statistical purposes. This information cannot be linked to a specific individual and cannot be cross referenced with other databases for matchmaking purposes;

3.3.2.2. The data is sent in real time to an external device to trigger an action that was set up for a specific context; for example, to play a certain video or sound for a person that fits a certain demographic group.

4. What do we collect? we may collect the following information:

4.1. Full name and job title

4.2. Picture

4.3. Contact information including phone numbers, mail address, home address and email address

4.4. Company name, address and website

4.5. Position in the company

4.6. Country name

4.7. For the hardware and other associated applications, we may also collect the external IP address, browser type, browser version, browser language, operating system, timezone, app version, errors generated and other player related information.

 

5. For how long do we collect?

The above-mentioned information which we collect will remain at our databases with no expiration date, until you ask to delete that data (probably, in case you decide to end our services).

6. How do we use your information? 

6.1. We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, website[s], software, applications, hardware, Cloud infrastructure hosted and maintained by us; or use certain other site features in the following ways:

6.1.1. Internal record keeping.

6.1.2. We may use the information to improve our products and services.

6.1.3. To personalise the user's experience and to allow us to deliver the type of content and product offerings in which you are most interested.

6.1.4. To allow us to better service you in responding to your customer service requests.

6.1.5. From time to time, we may also use your information to contact you for your order, subscription, market research or other products, services and news. We may contact you by email, phone, fax or mail. We may use the information to customise the website according to your interests.

6.2. 6.3. We process your personal information in the categories of data for legitimate interests pursued by us, which are described in detail in this privacy policy. We have undertaken to ensure that we place clear limitations on each of these uses so that your privacy is respected and only the information necessary to achieve these legitimate aims is used.

6.4. Our primary goal is to improve upon and make sure our services and messaging are relevant for all our users, while also ensuring that personal information of all users is respected and protected.

 

7. Legal use

7.1. To respond to legal requests or prevent fraud, we may need to use and disclose information or data we hold about you. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond. We collect and use the above mentioned data on the basis that we have to use this information in order to fulfil our contract with you.

 

8. Where do we store the information?

8.1. The above mentioned information which we collect will be stored in our cloud servers with multiple service providers around the world. We use Google Analytics, but with anonymization.

8.2. We also use HubSpot CRM service which, according to our best knowledge, has its servers in secure locations around the world.

 

9. Data retention

9.1. We do not delete data from tefoLOGIC Inc.’s services unless you request us to do so. In order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your user account. Hence, your files and data may remain on our servers even after deletion or termination of your user account.

 

10. Log data

10.1. Like most websites today, our web servers keep log files that record data each time a device accesses our servers. The log files contain data about the nature of each access, including originating IP addresses, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system versions, device type and timestamps.

 

11. Who is my data controller?

11.1. Your data controller is tefoLOGIC Inc. to the extent that it is processing your personal data.

 

12. Do we use ‘cookies’?

12.1. Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the pages which you have visited in our websites, in order to better understand your preferences. They are also used to help us understand your interests based on previous or current site activity, which enables us to provide you with improved services.

12.2. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We use both session cookies (temporary cookies that are deleted once you close your browser) and application cookies (permanent cookies that stay on your PC until you delete the browser’s cache).

13.4.1. If you disable cookies off, some features will be disabled It will turn off some of the features that make your site experience more efficient and some of our services will not function properly.

14. Information Sharing

14.1. We do not sell, trade, or otherwise transfer to outside parties your personal identifiable information.

14.2. Affiliated Businesses We Do Not Control: We work closely with affiliated businesses. In some cases, such as vendors, suppliers, delivery and logistics partners, these businesses require certain information to be able to provide services to you. In other cases, we provide services jointly with or on behalf of these businesses viz. co-branded and joint offerings. You can tell when a third party is involved in your transactions and we share customer information related to those transactions with that third party.

14.3. Third Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include installation, assembly, warehousing, packaging, transportation, fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analysing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes. Further, they must process the personal information in accordance with this Privacy Policy and as permitted by applicable law.

14.4. Promotional Offers: Sometimes we send offers to selected groups of tefoLOGIC Inc. customers on behalf of other businesses. When we do this, we do not give that business your name and address.

14.5. Business Transfers: As we continue to develop our business, we might sell or buy subsidiaries or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless, of course, the customer consents otherwise). Also, in the unlikely event that tefoLOGIC Inc. or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

 

15. Information Security

15.1. We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input in addition to maintaining security of your information as per the International Standard IS/ISO/IEC 27001 on "Information Technology Security Techniques Information Security Management System-Requirements".

15.2. We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personal information (including sensitive personal information). Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.

15.3. We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

15.4. We adopt industry appropriate data collection, storage and processing practices and security measures, as well as physical security measures to protect against unauthorised access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored in your user account.

15.5. Access to your name and email address is restricted to our employees who need to know such information in connection with providing tefoLOGIC Inc. Services to you and are bound by confidentiality obligations.

15.6. We do not use vulnerability scanning and/or scanning to PCI standards.

15.7. We do collect credit card information, but did not know PCI compliant scans are now required.

15.8. We do not use Malware Scanning.

15.9. We use an SSL certificate, unless you are a white labelled partner (reseller).

 

16. Information from Other Sources

16.1. We might receive information about you from other sources and add it to our account information.

16.2. Examples of information we receive from other sources include: updated delivery and address information from our delivery partners, agents, carriers or other third parties, which we use to correct our records and deliver your next purchase or communication more easily; account information, purchase or redemption information.

17. By using or continuing to use the site you agree to our use of your information (including sensitive personal information) in accordance with this Privacy Policy, as may be amended from time to time by tefoLOGIC Inc. in its discretion. You also agree and consent to us collecting, storing, processing, transferring and sharing information (including sensitive personal information) related to you with third parties or service providers for the purposes as set out in this Privacy Policy.

18. We may be required to share the aforesaid information with government authorities and agencies for the purposes of verification of identity or for prevention, detection or investigation, including cyber incidents, prosecution and punishment of offences. You agree and consent for tefoLOGIC Inc. to disclose your information, if so required, under applicable law.

 

19. If you have any concern about privacy or grievances, please contact us with a thorough description and we will try to resolve the issue for you.

20. Our business changes constantly and our Privacy Policy and the Conditions of Use will change also. We may choose to send you email reminders of our notices and conditions, but you should check our website frequently to see recent changes.

21. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.

We are not responsible for the manner of use or misuse of information made available by you at such other websites. We encourage you not to provide Personal Information, without assuring yourselves of the Privacy Policy of such other websites.

22.2. Our websites (www.tefologic.com other sub-domains) may contain links to other websites of interest. However, once you have used these links to leave our sites, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

 

23. Social Widgets

23.1. tefoLOGIC Inc. supports third party widgets, such as Facebook and Twitter buttons on the website, that allow users to share articles and other information on different platforms. These widgets may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the widgets to function properly. These widgets do not collect or store any personal Information from users on the website and simply act as a bridge for your convenience in sharing information. Your interactions with these widgets are governed by the privacy policy of the company providing it.

 

24. COPPA (Children Online Privacy Protection Act)

24.1. When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

24.2. We do not specifically market to children under 18.

24.3. Generally, our services are not intended for and may not be used by minors. “Minors” are individuals under the age of 13 (or under a higher age if permitted by the laws of their residence).

24.4. tefoLOGIC Inc. does not knowingly collect personal data from Minors or allow them to register. If it comes to our attention that we have collected personal data from a Minor, we may delete this information without notice. If you have reason to believe that this has occurred, please contact customer support at support@tefologic.com.

25. Fair information practices

25.1. The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

25.2. In order to be in line with Fair Information Practices and GDPR we will take the following responsive action, should a data breach occur:

25.2.1. We will notify the users via email within 3 business days and will notify the European Union relevant officer within 24 hours from the moment we know of such a data breach.

25.3. We also agree to the Individual Redress Principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

 

26. CAN SPAM Act

26.1. The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

27. Controlling your personal information

27.1. You may choose to restrict or delete (the right “to be forgotten”) the collection or use of your personal information by writing to or emailing us at info@tefologic.com

27.2. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.

27.3. You may request details of personal information which we hold about you under the Data General Data Protection Regulation (“GDPR” – Regulation (EU) 2016/679). If you would like a copy of the information held on you please write to info@tefologic.com

27.4. If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible, at the above address. We will promptly correct any information found to be incorrect.

28. Your rights

28.1. Upon request and once we have verified your identity, we will provide you with information about whether we hold any of your personal information. Users who wish to correct, update or remove any personal information, including those from a public forum, directory or testimonial on our site, may do so either by accessing their user account or by contacting tefoLOGIC Inc. customer support services at support@tefologic.com. Such changes may take up to 48 hours to take effect.
